Service Description: The Service is designed to provide consumers with access to data, information, points of interest, activities, special offers, experiences, and deals regarding local destinations and activities, and to provide contact with local tour operators or companies (hereinafter collectively referred to as “Partners”) a platform to easily provide consumers with such information and offers.

Registration: To access and use certain features of the Service, you must register at Colombiatours.travel. If you choose to register for the Service, you agree to provide and maintain true, accurate, current, and complete information about yourself as prompted by the Service’s registration form. Registration data and other information about you are governed by our Privacy Policy. If you are under 13 years of age, you are not authorized to use the Service, with or without registration.

User Account, Password, and Security: You are responsible for maintaining the confidentiality of your password and account, if applicable, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Colombiatours.travel of any unauthorized use of your password or account or any other breach of security and ensure that you exit from your account at the end of each session when accessing the Service. Colombiatours.travel will not be liable for any loss or damage arising from your failure to comply with this Section.

Terns of use

User Conduct: You are solely responsible for all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”) that you upload, post or display (hereinafter, “publish”) or transmit or otherwise use through the Service. Colombiatours.travel reserves the right to investigate and take appropriate legal action against anyone who, in its sole discretion, violates this provision, which includes, but is not limited to, removing offensive content from the Service, suspending or canceling the account of such offenders and reporting them to the competent authorities.

User Fee Terms: When you purchase an experience, Colombiatours.travel will charge you the full or partial amount of such experience to your credit card or other payment method. In the event that the host rejects your reservation or expires in any other way, you will be entitled to a refund in accordance with our refund policy. In the event that you encounter a different problem with your reservation and contact Colombiatours.travel within 24 hours of the start time of the experience, Colombiatours.travel reserves the right to refund a portion or all of the value charged based on the communication of the service team with the Partner (operator) and you. In addition to the fees you pay for the Offers, you acknowledge that Colombiatours.travel reserves the right to charge for the service portion of the total value Service (“Service Fees”) and to change its Service Fees from time to time. You agree to pay all fees when due in accordance with the terms set forth on the Site and these Terms of Service. If you have to provide Colombiatours.travel with information regarding your credit card or other payment instrument, you represent and warrant that such information is true and that you are authorized to use the payment instrument. You will promptly update your account information with any changes (such as a change in your billing address or credit card expiration date) that may occur. If you dispute any charge, you must notify Colombiatours.travel within sixty (60) days of the date we charged you. If Colombiatours.travel cancels your account and use of the Service because you have breached these Terms of Service, you will not be entitled to a refund of any portion of unused fees or payments (if applicable).

Intellectual Property Rights

Content, Software, and Trademarks: You acknowledge and agree that the Service may contain content (“Content of the Service”) that is protected by copyright, patents, trademarks, trade secrets, or other rights and intellectual property laws. Except as expressly authorized by Colombiatours.travel in connection with your use of the Service, you shall not engage in or use any data extraction method, robot, scraping or data collection or similar data extraction. Any use of the Site or the Content of the Service that is not specifically authorized herein is strictly prohibited. The technology and software underlying the Service are the property of Colombiatours.travel. All rights not expressly granted here are reserved by Colombiatours.travel.

The Colombiatours.travel name and logo are trademarks and service marks of Colombiatours.travel. The names and logos of other companies, products and services used and displayed through the Service may be trademarks or service marks of their respective owners who may or may not endorse or be affiliated or connected with Colombiatours.travel.

Service Guarantee

The support team ensures the safety and suitability of the products published by the Partners (affiliated operators) on the platform. Limitation of Liability

Colombiatours.travel will not be liable for any damages arising from any event due to the use or inability to use the platform, regardless of whether Colombiatours.travel has been advised of the possibility of such damages, except where liability is mandatory, in which case liability for damages shall be limited to the price of the activity.

Colombiatours.travel makes no representation or warranty regarding the reliability, timeliness, quality, suitability or availability of the activities or any of the services requested through the use of the platform. Colombiatours.travel does not guarantee the quality, suitability, safety or skill of the Partners in the activities. the user agrees that all risk arising from his use of the activities and any service in relation to those will be solely his, to the maximum extent permitted by applicable law.

The user may use the Colombiatours.travel platform to request and book activities carried out by Partners, but accepts that Colombiatours.travel has no liability whatsoever to the user in relation to the activity itself or any transportation or other services provided to the user by the Partner other than as expressly set forth in these conditions.

The limitations and waiver in this document are not intended to limit liability or alter the rights that the user as a consumer has and that cannot be excluded under applicable law.

Termination

You agree that Colombiatours.travel, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of the Service and remove and discard any content within the Service, for any reason, including, but not limited to, lack of use. Or if Colombiatours.travel believes that you have violated or acted in a manner inconsistent with these Terms of Service. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of the Service may be referred to the relevant law enforcement authorities. Colombiatours.travel may also, in its sole discretion and at any time, suspend the provision of the Service, or any part thereof, with or without prior notice.
